Terms & Conditions

These Terms & Conditions are the agreement between you (the student, or the parent or guardian booking on a student’s behalf) and KWC Drivers (“we”, “us”, “our”) for every lesson, course, package, or add-on you book with us. By completing checkout or starting a lesson, you confirm you have read and accepted these terms.

1. Who we are and what we do

KWC Drivers is an MTO-approved Beginner Driver Education (BDE) course provider operating in Kitchener-Waterloo, Ontario. We deliver in-class (online) instruction, in-car lessons, and road-test packages for G1, G2, and G drivers.

What we do not do:

  • We do not issue driver’s licences. Only ServiceOntario and the MTO do that.
  • We do not guarantee that you will pass any DriveTest road test. Passing depends on your performance on test day.
  • We do not provide legal advice about traffic tickets, insurance disputes, or licence suspensions.

2. Booking and payment

We accept three payment methods at checkout:

  • Credit or debit card processed by Stripe
  • Interac e-Transfer to the address shown at checkout
  • Cash paid in person before your first lesson

All prices are in Canadian dollars (CAD) and include 13% Ontario HST, calculated and shown at checkout. Your booking is confirmed only once payment, or your e-Transfer or cash arrangement, is received.

For multi-lesson packages, the full balance is due at booking unless we have agreed to a written payment plan.

3. Cancellations by you

We need at least 24 hours’ notice to cancel or reschedule an in-car lesson without penalty.

  • Cancellations or reschedules with less than 24 hours’ notice are charged a late-cancellation fee of $40, or the full lesson is forfeited at our discretion.
  • A no-show (you do not arrive within 15 minutes of the scheduled pickup time, and have not contacted us) forfeits the full lesson fee.
  • Documented illness, family emergency, or a positive COVID-19 test waives the late-cancellation fee. Please email us as soon as you know.
  • A returned or failed e-Transfer or declined card payment is charged a $35 administrative fee per occurrence.

4. Late arrival

Instructors will wait 15 minutes at the agreed pickup point. After that, the lesson is treated as a no-show. Lessons that begin late still end at their originally scheduled time so other students are not delayed.

5. Cancellations by us (weather, vehicle, instructor)

We may cancel or reschedule a lesson because of:

  • Severe weather, unsafe road conditions, or air-quality advisories
  • Vehicle mechanical issues
  • Instructor illness or unavoidable absence
  • Any other safety or operational concern

When we cancel, we will reschedule at no extra cost. We do not pay compensation for travel, missed work, or other indirect costs caused by a cancellation on our side.

6. Instructor assignment and substitution

We do our best to keep you with the same instructor throughout your lessons, but we reserve the right to assign or substitute any qualified, MTO-licensed instructor on our team.

7. G1 licence and student conduct

  • A valid G1 licence in your name is required at every in-car lesson. Showing up without it means the lesson may be forfeited at our discretion.
  • You must arrive sober, well-rested, wearing closed-toe footwear, and with corrective lenses if your licence requires them.
  • Aggressive, abusive, threatening, or discriminatory behaviour toward an instructor or other students ends the lesson immediately and may end the entire enrollment with no refund.

8. Vehicle and insurance

Our training vehicles carry the insurance required by Ontario law for driving instruction. While you are driving under instruction:

  • Our instructor controls the dual brake and is responsible for vehicle safety decisions.
  • You are not personally liable for ordinary collision damage that occurs during lawful instruction.
  • You are responsible for damage caused by gross negligence, intoxication, illegal acts, or refusal to follow instructor direction. In those cases you may be charged the insurance deductible and any uncovered repair costs.

9. BDE course completion

To receive your BDE certification we follow MTO standards:

  • You must score at least 70% on all e-learning and in-car evaluations.
  • You must complete the full course (in-class, in-car, homelink) within 12 months of your start date.
  • We will not provide any further instruction past 364 days from your start date. After that you must re-enroll at our current published pricing.

Once you complete the course we submit your BDE completion electronically to the MTO. Ontario driving schools cannot issue licences directly; you can confirm your BDE status by pulling a Driver’s Licence History from ServiceOntario.

10. Refunds

Our full refund policy lives at /faq/refund-policy/. In short:

  • Refund requests after the course has started are subject to a $55 administrative fee.
  • Approved refunds are returned to the original payment method within 10 business days.
  • Lessons forfeited under sections 3, 4, or 7 are not refundable.

11. Limitation of liability

To the fullest extent permitted by Ontario law, KWC Drivers’ total liability to you for any claim arising out of these terms or your lessons is limited to the amount you paid us for the specific lesson or package the claim relates to. We are not liable for indirect, incidental, or consequential losses (for example, missed road tests, lost wages, insurance premium changes).

Nothing in this section limits liability that cannot be limited by law, including liability for personal injury caused by our negligence.

12. Changes to these terms

We may update these terms from time to time. The “Updated” date at the top shows the current version. If we make a material change that affects active students, we will email you. Continuing to take lessons after a change means you accept the new version.

13. Governing law

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply in Ontario. You and KWC Drivers agree that any dispute will be resolved in the courts of Ontario, and we both submit to their exclusive jurisdiction.
